Prior to the hearing, on July 30, 2019 at 6:00 p.m., Complainant emailed Investigator Dennis Bierma. Complainant indicated, “The turf supplier came and worked on the turf. They did not replace it but it is acceptable.” On the date of hearing, Complainant failed to appear at the hearing. The Office of Administrative Hearings contacted Complainant to discuss her intentions and verify the email. Complainant appeared telephonically and stated that she wished to withdraw her complaint against Respondent and close the case. Based on Complainant’s email and verbal withdrawal of appeal, this matter is hereby vacated from the calendar of the Office of Administrative Hearings and the matter is remanded to the referring agency for further action.
