FINDINGS OF FACT
On August 17, 2018, the Registrar issued a Citation and Complaint in Case No. 2018-3705, which consolidated nine pending complaints against Respondent. This case, 2018A-2307-CHC-ROC, was included in the Citation and Complaint in case number 2018-3705.
On August 17, 2018, Thomas Sean Turner, Respondent’s Qualifying Party, signed a Consent Order revoking Respondent’s license on August 20, 2018 as a direct result of this Complainant’s Complaint in 2018A-2307-CHC-ROC, among others.
The Consent Order was mailed to all interested parties on August 20, 2018.
Scapes and Stones LLC, license number 290620 has already received discipline against Respondent’s license in case number 2018A-3705 under the terms of the Consent Order revoking Respondent’s license.
Zane Edward Wilsterman, Complainant in this case 2018A-2307-CHC-ROC, appeared, was sworn and testified that he has reviewed a copy of the Consent Order revoking Respondent’s license in 2018A-3705, ROC the Investigator Job Site Inspection Notes and the ROC Investigator’s Directive regarding Mr. Wilsterman’s Complaint against the Respondent.
In light of the admissions and discipline imposed by the Registrar under the Consent Order revoking Respondent’s license, Complainant stated on the record that he concurs or otherwise does not object to this matter being vacated and dismissed.
RECOMMENDED ORDER
Pursuant to the terms and requirements of the Consent Order revoking Respondent’s license on August 20, 2018 in consolidated case number 2018-3705, the Respondent has already been disciplined by the Registrar in this case 2018A-2307-CHC-ROC.
IT IS THEREFORE RECOMMENDED that this matter be dismissed and closed.
FURTHER IT IS RECOMMENDED that this case be remanded to the Registrar for such further action the Registrar may deem necessary and proper.
