HEARING

When the parties convened for hearing, the parties wished to continue this matter based upon the fact that Respondent had intended to file an appeal in the Superior Court regarding the underlying matter. This matter has been continued multiple times due to the pending appeal filed by Respondent.

The parties were requested to provide a written response by June 7, 2021, advising the Tribunal how they believe this administrative matter pending before the Office of Administrative Hearings should proceed given the pending appeal in Superior Court. The parties were advised that in the event they failed to respond, the matter would be vacated from the calendar of the Office of Administrative Hearings and remanded to the Registrar of Contractors for further action. Neither party, nor the assigned Assistant Attorney General, filed a response.

Therefore,

IT IS HEREBY ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings.

IT IS FURTHER ORDERED remanding this matter to the Registrar of Contractors for further action.
