COMPLAINANT,

v.

Double C Electric LLC,

License No:

208771

RESPONDENT.

No. 2018A-2036-NPC-ROC

ADMINISTRATIVE LAW JUDGE DECISION

HEARING: July 17, 2018.

APPEARANCES: No appearances

ADMINISTRATIVE LAW JUDGE: Randolph D. Wolfson

_____________________________________________________________________

FINDINGS OF FACT

Notice of Hearing in this matter was served upon the Complainant, by U.S. Mail, at the address listed in its Complaint. No Motion to Continue or request to appear telephonically was filed in this case.

Complainant failed to appear at the hearing. The tribunal waited 20 minutes beyond the scheduled start time, but no one appeared for Complainant.

CONCLUSIONS OF LAW

The copies of the Notice of Hearing that the Registrar mailed to Respondent at its address of record and at the address on its written answer were reasonable and Respondent is deemed to have received notice of the hearing. A.R.S. §§ 41-1092.04 and 41-1092.05(D).

By failing to appear at the hearing, Complainant did not meet the burden to present evidence in support of the complaint. See A.A.C. R2-19-119.

RECOMMENDED ORDER

Based on the foregoing, it is recommended that on the effective date of the Registrar of Contractors’ Order, Complainant’s complaint be dismissed.

In the event of certification of the Administrative Law Judge Decision by the Director of the Office of Administrative Hearings, the effective date of the Order will be 40 days from the date of that certification.

Done this day, July 19, 2018.
