IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On June 5, 2017, a hearing on the merits was commenced in this matter. The parties agreed in writing to a settlement that required Wayne Thomas Clifford DBA: Wayne T. Clifford Construction (“Respondent”) to make seven monthly payments to Tara Phelps (“Complainant”). At the parties’ request, the Administrative Law Judge set a status conference after the due date of the first three payments. The order setting the status conference allowed the parties to appear telephonically by providing number to the Office of Administrative Hearings and informed them that, “[i]f the parties neither provide a telephone number nor appear personally at the status conference, the Administrative Law Judge will infer that they have consummated their settlement and remand this matter back to the Registrar of Contractors.” The parties neither provided telephone numbers nor appeared personally at the status conference. Therefore, IT IS ORDERED vacating the status conference that had been scheduled on this date and any further hearing on the merits that could have been scheduled in this matter. IT IS FURTHER ORDERED remanding this matter under A.A.C. R2-19-111(4) to the Director of the Arizona Registrar of Contractors for further action. / / / / / / / / Done this day, August 11, 2017.
