Under A.R.S. § 41-1092.08(B), the Registrar may review and accept, modify, or reject an

administrative law judge’s written decision. If the Registrar modifies or rejects that decision, then the

Registrar must provide written justification setting forth the reasons for the modification or rejection.

REGISTRAR’S ACCEPTANCE

In this case, a hearing was held, and the administrative law judge issued a written decision. See

Administrative Law Judge Decision, attached. The Registrar reviewed that decision and hereby accepts it.

CONCLUSION

Because the Registrar has accepted the administrative law judge’s decision, that decision is the

final administrative decision in this case and becomes effective on July 25, 2018.

IT IS FURTHER ORDERED that Respondent pay a civil penalty in the amount of $250.00 payable to the Registrar on or before 30 days from the effective date of this Order. FINAL NOTE

The Registrar corrects and replaces page 2, lines 12-30 and page 3, lines 1-3 of the Decision with,

“Complaint Item 1: The 4 panel 16′ x 10′ sliding pocket door does not operate correctly. It does not open all the way. panel 16′ x 10′ sliding pocket sliding glass doors require large amount of force to open. Respondent is to ensure proper installation of the 4 panel 16′ x 10′ sliding pocket sliding glass doors and, operate as intended and ensure that work is performed in a professional and workmanlike manner.

Complaint Item 2: The 4 panel 16′ x 10′ sliding pocket door does not open well (uses full body force to move it). Respondent is to ensure that the 4 panel 16′ x 10′ sliding pocket sliding glass doors operate as intended and ensure that work is performed in a professional and workmanlike manner. Complaint Item 3: The 4 panel 16′ x 10′ sliding pocket door construction is poor. The large frame on the large plate glass is easily separated from the glass when trying to close the door. Left stile of door frame with handle (active panel with handle) flexes when pulled. Respondent is to ensure that active panel door frame does not flex when operated. Complaint Item 8: The 5 panel 20′ x 10′ sliding pocket door wasn’t measured correctly so the lead panel does not close or seal properly. This is per representative of Lato Glass. Active panel interlock does not fully engage. Respondent is to ensure that active panel interlock fully engages when active panel door (operating door), is closed.

Addendums at jobsite inspection

Complaint Item 10: Respondent cracked tiles last time he came out to perform repairs. Tile with large corner section missing and numerous chipped tiles in the interior of the structure next to track of the 4 panel 16′ x 10′ sliding pocket door and one patio tile adjacent to the track on the east side with large section missing.” Dated this 15th day of June 2018.
