Under A.R.S. § 41-1092.08(B), the Registrar may review and accept, modify, or reject an
administrative law judge’s written decision. If the Registrar modifies or rejects that decision, then the
Registrar must provide written justification setting forth the reasons for the modification or rejection.
MODIFICATION AND WRITTEN JUSTIFICATION
The Registrar elects to modify the Administrative Law Judge Decision. On page 5, line 8 “until” is
to be replaced with “unless” because once a license is revoked, it may not be reinstated. Therefore, the
intent of the Administrative Law Judge to place a condition upon the revocation is properly effected by
the modification. The Registrar accepts the rest of the recommended decision.
CONCLUSION
Because the Registrar has modified the administrative law judge’s decision, the modified decision is the final administrative decision in this case and becomes effective on September 13, 2017. Dated this 4th day of August 2017.
