At the time and place set for hearing after all the testimony was taken, the parties agreed to attempt to resolve the matter via Respondent performing corrective work. Specifically, Respondent agreed to replace three areas of cool decking that had cracks of at least 1/16th of an inch in width. Because doing so might take some time, the parties agreed that by the close of business on December 1, 2017, Complainant would advise the Tribunal in writing whether the matter was resolved or the record should be closed for issuance of a recommended decision. Done this day, September 5, 2017.
