FINDINGS OF FACT
Applicant failed to appear at the hearing. A person who identified herself as Monica Corbin appeared by telephone at the hearing and stated that she was the wife of the owner of Corbin Roofing, LLC. However, Monica Corbin stated that she was not an employee or officer of the company. Ms. Corbin stated that her husband would file a motion to vacate the hearing. However, the tribunal has not received a motion to vacate the hearing.
CONCLUSIONS OF LAW
By failing to appear at the hearing, Applicant did not meet the burden to present evidence in support of the appeal. See A.A.C. R2-19-119.
RECOMMENDED ORDER
Based on the foregoing, it is recommended that on the effective date of the Registrar of Contractors’ Order, Applicant’s appeal be dismissed.
In the event of certification of the Administrative Law Judge Decision by the Director of the Office of Administrative Hearings, the effective date of the Order will be 40 days from the date of that certification.
