Under A.R.S. § 41-1092.08(B), the Registrar may review and accept, modify, or reject an

administrative law judge’s written decision. If the Registrar modifies or rejects that decision, then the

Registrar must provide written justification setting forth the reasons for the modification or rejection.

MODIFICATION AND WRITTEN JUSTIFICATION

The Registrar removes the $500.00 civil penalty assessed on page 6, line 22 in the Administrative

Law Judge Decision because the citation was brought under A.R.S. § 32-1154(A)(10), not A.R.S § 32-

1166. The assessment of a civil penalty is not appropriate for a charge of A.R.S § 32-1154(A)(10).

Similarly, the Registrar removes paragraph 15 on page 6 and footnote 4 on page 6 because the references

to A.R.S § 32-1166 are inaccurate as to the charge within the citation.

CONCLUSION The Registrar hereby modifies the Administrative Law Judge Decision to remove the civil penalty. The Registrar hereby accepts the remainder of the decision in this case and becomes effective on September 20, 2017.
