A status conference had been scheduled on this date to allow Richard Rada (“Respondent”) additional time to submit a signed statement from complaining homeowner, Geraldine Woodyatt, that Respondent had resolved her complaint and to submit evidence that he has obtained a contractor’s license to support a reduction in the amount of the civil penalty. The Registrar of Contractors’ (“the Registrar’s”) attorney appeared at the status conference, but Respondent did not, even though the Administrative Law Judge (“ALJ”) left telephone messages for Respondent and the status conference did not end until sixteen minutes past the time at which it was scheduled. The Registrar’s attorney stated that neither he nor the Registrar’s investigator assigned to this case had received any written communication from Respondent. At the Registrar’s attorney’s suggestion, IT IS ORDERED holding the record open in this matter until September 15, 2017, at 5:00 p.m., to allow Respondent one last opportunity to submit to the Office of Administrative Hearings and to the Registrar evidence that would support a reduction in the amount of the civil penalty. The Registrar may respond to any evidence that Respondent submits, but if no evidence is forthcoming, the ALJ will make a recommendation to the Registrar based on the evidence submitted at the June 8, 2017 hearing on the merits.
