FINDINGS OF FACT
On January 26, 2017, The Arizona Registrar of Contractors duly issued a Notice of Hearing setting the above-captioned matter for hearing at 1:00 p.m. on
March 8, 2017, at the Office of Administrative Hearings in Phoenix, Arizona.
Complainant failed to appear at the hearing. The tribunal waited 20 minutes beyond the scheduled start time, but no one appeared for Complainant.
On March 24, 2017, Complainant filed a Motion for Continuance on March 24, 2017. The Motion for Continuance was denied on March 28, 2017.
CONCLUSIONS OF LAW
1. By failing to appear at the hearing, Complainant did not meet the burden to present evidence in support of the complaint. See A.A.C. R2-19-119.
RECOMMENDED ORDER
Based on the foregoing, it is recommended that on the effective date of the Registrar of Contractors’ Order, Complainant’s complaint in Case No. 2016-4996 be dismissed.
In the event of certification of the Administrative Law Judge Decision by the Director of the Office of Administrative Hearings, the effective date of the Order will be 40 days from the date of that certification.
