Under A.R.S. § 41-1092.08(B), the Registrar may review and accept, modify, or reject an administrative law judge’s written decision. If the Registrar modifies or rejects that decision, then the Registrar must provide written justification setting forth the reasons for the modification or rejection. MODIFICATION AND WRITTEN JUSTIFICATION The Registrar modifies the Administrative Law Judge’s Recommended Decision that this complaint be closed. The Registrar believes that a dismissal against Respondent’s license is appropriate in this case, because the matter is a contested case in which the Complainant has the burden, and the Administrative Law Judge’s Decision found that Respondent did not violate either A.R.S. § 32-1154(A)(3) or (A)(22). ALJ Dec. 4:9-12. CONCLUSION AND ORDER The Registrar hereby replaces “close Complainants Gilbert and Helene Lustig’s complaint” found on page 4, of the Administrative Law Judge’s Recommended Decision with “dismiss Complainants Gilbert and Helene Lustig’s complaint.” The Registrar hereby accepts the remainder of the Administrative Law Judge Decision, which becomes effective on May 24, 2017.
