Respondent moved for dismissal of the complaint because it had filed bankruptcy and Complainant was pursuing its claim in the bankruptcy court. Respondent further contended that the administrative hearing on the Citation would violate the automatic stay provisions of the bankruptcy code. Because the Citation relates to a no pay complaint, the Tribunal agrees that the automatic stay applies and IT IS ORDERED that hearing in this matter be vacated. Done this day, February 6, 2017.
