IN THE OFFICE OF ADMINISTRATIVE HEARINGS

A hearing on the merits was held on February 17, 2017. During the hearing, the parties agreed to settle their dispute. At the parties’ request, a status hearing had been scheduled on this date to ensure that Respondent fully performed the terms of the settlement agreement. Respondent’s representative requested to appear telephonically at the status conference. Complainant neither requested to appear telephonically nor appeared personally at the status conference. Respondent’s representative stated that it had fully performed the settlement agreement. Therefore, IT IS ORDERED vacating the any further hearing on the merits that could have been scheduled in this matter. IT IS FURTHER ORDERED remanding this matter under A.A.C. R2-19-111(4) to the Director of the Arizona Registrar of Contractors with the recommendation that it be closed as resolved/settled/withdrawn. Done this day, April 27, 2017.
