Under A.R.S. § 41-1092.08(B), the Registrar may review and accept, modify, or reject an

administrative law judge’s written decision. If the Registrar modifies or rejects that decision, then the

Registrar must provide written justification setting forth the reasons for the modification or rejection.

In this case, a hearing was held, and the administrative law judge issued a written decision. See

Administrative Law Judge Decision, attached.

MODIFICATION AND WRITTEN JUSTIFICATION

Page 2, ¶ 6, pf the Decision indicates that after a jobsite inspection Investigator Klein issued a

written directive to Respondent. However, after a jobsite inspection the written directive was issued to

the Respondent by Investigator Dimond. Page 3, ¶ 8, lists July 29, 2016 as the date the Registrar issued a

Citation against Respondent. However, the Registrar issued the Citation on August 25, 2016. CONCLUSION AND ORDER For sake of clarity, the Registrar hereby replaces, “Klein” found on Page 2, ¶ 6, of the Decision with “Dimond”. The Registrar hereby replaces, “July 29, 2016” found on page 3, ¶8, of the Decision with “August 25, 2016.” The Registrar hereby accepts the remainder of the Administrative Law Judge Decision, which becomes effective on February 6, 2017.
