At the conclusion of the Complainant’s case-in-cheif, the hearing officer briefly adjourned to provide the parties an opportunity to discuss -out of the presence of the ALJ - the possibility of settlement of this matter. After having reconvened and gone back on the record, the parties indicated that the they had reached a settlement of all outstanding issues in this matter.

On the record, counsel for the Recovery Fund advised that as part of the parties’ agreement in settlement of this matter, it would rescind its offer of payment in order for the Complainant provide the Recovery Fund with new and additional facts in this matter regarding the cost and scope of work actually provided to the Complainant for repairs made by her Contractor. The Recovery Fund agreed to consider these new and additional facts, when presented. Thereafter, the Recovery Fund agreed it would review the materials provided by the Complaint to revise and reissue a modified offer of payment to the Complainant. Based upon the Recovery Funds’ offer on the record, the Complainant advised she wished to withdraw the Complaint in this matter.

Sufficient cause appearing, IT IS HEREBY ORDERED that this case should be and is hereby dismissed.
