IN THE OFFICE OF ADMINISTRATIVE HEARINGS

A hearing on the merits was scheduled in this matter on October 18, 2016, in the Registrar of Contractors’ (“the Registrar’s”) Tucson office. The Registrar’s Investigator testified and James and Natalie Riley (“Complainants”) and Rogo’s Finishing Touch Inc. (“Respondent”) agreed to resolve their differences by Respondent performing certain corrective work. To accommodate the parties, the Administrative Law Judge (“ALJ”) scheduled a status conference on October 31, 2016, and allowed the parties to appear telephonically at the status conference. Because neither party appeared or provided a telephone number at which they could be reached, the ALJ infers that the parties were able to successfully resolve their differences. Therefore, IT IS ORDERED vacating the any further hearing on the merits in this matter at this time. IT IS FURTHER ORDERED remanding this matter under A.A.C. R2-19-111(4) to the Director of the Registrar with the recommendation that it be closed as resolved/settled/withdrawn, without prejudice to Complainants’ right to request that their complaint be reopened if Respondent has not fully resolve the complaint to their satisfaction.
