Under A.R.S. § 41-1092.08(B), the Registrar may review and accept, modify, or reject an

administrative law judge’s written decision. If the Registrar modifies or rejects that decision, then the

Registrar must provide written justification setting forth the reasons for the modification or rejection.

In this case, a hearing was held, and the administrative law judge issued a written decision. See

Administrative Law Judge Decision, attached.

MODIFICATION AND WRITTEN JUSTIFICATION

Page 6, under the Recommended Order section of the Decision lists $1,825.00 as the payout

amount the complainant should receive from the Residential Contractors’ Recovery Fund. Page 3, ¶ 10,

states “The Registrar issued a Notice of Claim for Administrative Payout finding that Complainant’s

actual damages were $1,836.00.” Page 5, ¶ 4, states “The award thus appears to properly remedy the sole workmanship violation for which the Registrar cited Respondent.” CONCLUSION AND ORDER For sake of clarity, the Registrar hereby replaces, “1,825.00” found on page 6, under the Recommended Order section of the Decision with $1,836.00. The Registrar hereby accepts the remainder of the Administrative Law Judge Decision, which becomes effective on February 27, 2017.
