REGISTRAR OF CONTRACTORS OF THE STATE OF ARIZONA
IN THE MATTER OF THE CIVIL PENALTY CITATION ISSUED TO: Case No. 2015-3822 Docket No. 2015A-3822-ROC Edgar Villalobos Huante FINAL ADMINISTRATIVE DECISION RESPONDENT AND ORDER
Under A.R.S. § 41-1092.08(B), the Registrar may review and accept, modify, or reject an administrative law judge’s written decision. If the Registrar modifies or rejects that decision, then the Registrar must provide written justification setting forth the reasons for the modification or rejection. In this case, a hearing was held and the administrative law judge issued a written decision. See Administrative Law Judge Decision, attached. MODIFICATION AND WRITTEN JUSTIFICATION Providing an additional thirty days to pay the civil penalty is not necessary in this matter. Respondent was notified in the Cease & Desist Order that a civil penalty would be assessed for contracting without a license. Additionally, there is no statute that allows additional time to pay civil penalties. CONCLUSION AND ORDER The Registrar hereby removes the phrase “thirty days after” from the Administrative Law Judge’s Recommended Order, found at line 4, page 4 of the Administrative Law Judge Decision. Therefore, the $1,500.00 civil penalty must be paid no later than the effective date of this order which is April 11, 2016. Payment must be mailed to: Registrar of Contractors P.O.
