IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This matter was originally set for hearing on December 4, 2015. Helen M. Freeman (“Complainant”) failed to appear for the December 4, 2015 hearing and failed to submit a request to the Office of Administrative Hearings (“OAH”) to appear telephonically. The Registrar of Contractor (“Registrar”) subsequently granted Complainant’s request for rehearing. A rehearing on the merits was held on June 13, 2016. At R N B Flooring Inc.’s (“Respondent’s”) representative’s request, the Administrative Law Judge (“ALJ”) placed a call to Complainant to allow her to appear telephonically. Complainant complained that Respondent had failed to repair two small items of deficient workmanship. Respondent agreed to repair the deficiencies and Complainant agreed to provide access for Respondent to perform the repairs. The ALJ held the record open to allow Respondent to confirm in writing that it had completed the repairs and if Complainant was not satisfied with the repairs, to allow her to inform the ALJ in writing of her dissatisfaction. Respondent has filed a written statement that it has performed the repairs. Complainant has not ailed any written statement controverting Respondent’s statement. Therefore, IT IS ORDERED remanding this matter to the Registrar with the recommendation that it be closed as “resolved/settled/withdrawn.” Done this day, July 14, 2016.
