On October 7, 2016, a hearing on the merits was held on the complaint that Julia Ann Heselton (“Complainant”) had filed against Renova, LLC (“Respondent”) with the Registrar of Contractors (“the Registrar”) alleging poor work by Respondent in renovating Complainant’s house. At the hearing, Complainant agreed to allow Respondent to perform and Respondent’s representative agreed that Respondent would perform certain corrective action to resolve Complainant’s complaint. To allow the parties to consummate their settlement, the Administrative Law Judge (“ALJ”) set three status conferences. Before the first two status conferences, Complainant requested that the status conference be continued to allow Respondent to continue its corrective work. Complainant did not request that the status conference that was scheduled on this date be continued. Neither party requested to appear telephonically at any of the status conferences. Because the ALJ infers from the parties’ failure to appear for the status conference scheduled on this date that they have resolved their dispute, IT IS ORDERED vacating the status conference that had been scheduled on this date and any further hearing on the merits that could have been scheduled in this matter. IT IS FURTHER ORDERED remanding this matter under A.A.C. R2-19-111(4) to the Director of the Arizona Registrar of Contractors for further action.
