administrative law judge’s written decision. If the Registrar modifies or rejects that decision,

then the Registrar must provide written justification setting forth the reasons for the modification

or rejection.

In this case, a hearing was held and the administrative law judge issued a written

decision. See Administrative Law Judge Decision, attached.

MODIFICATION AND WRITTEN JUSTIFICATION

The Administrative Law Judge Decision cites A.R.S. § 32-1154(F) as the statute giving the Registrar the authority to impose a civil penalty in this case. The applicable statute is A.R.S. § 32-1166. Section 32-1154(F) applies to licensees for violations of 32-1154(17), whereas Section 32-1166 applies to any person, whether licensed or not. CONCLUSION AND ORDER The Registrar hereby replaces “A.R.S. § 32-1154(F)”, found on line 11, page 2 of the Administrative Law Judge Decision, with “A.R.S. § 32-1166.” The Registrar hereby accepts the substance of the Administrative Law Judge Decision, which becomes effective on December 14, 2015.
