OF THE STATE OF ARIZONA IN THE MATTER OF THE CIVIL ) CASE NO: 2015-1231 ) PENALTY CITATION ISSUED TO: ) DOCKET NO. 2015A-1231-ROC ) Terry Michel Turmes ) ) FINAL ADMINISTRATIVE RESPONDENT ) DECISION AND ORDER Under A.R.S. § 41-1092.08(B), the Registrar may review and modify an administrative law judge’s written decision. If the Registrar modifies that decision, then a “written justification setting forth the reasons for the modification” must be provided. A.R.S. § 41- 1092.08(F)(1). In this case, a hearing was held and the administrative law judge issued a written decision. See attached Administrative Law Judge Decision. Because the Registrar is modifying the administrative law judge’s written decision that allows for the civil penalty to be paid thirty days after the effective date, the Registrar provides the following written justification. WRITTEN JUSTIFICATION REQUIRED BY A.R.S. § 41-1092.08(B)

Providing an additional thirty days to pay the civil penalty is not necessary in this matter.

Respondent was notified in the Cease & Desist Order that a civil penalty would be assessed for

contracting without a license, nor is there a statute that allows additional time to pay these civil

penalties.

CONCLUSION AND ORDER

The Registrar therefore removes “thirty days after” from the Administrative Law Judge’s

Recommended Order. ALJ Decision 11: 17

Therefore, the $500.00 civil penalty must be paid no later than September 14, 2015.
