Under A.R.S. § 41-1092.08(B), the Registrar may review and accept, modify, or reject an

administrative law judge’s written decision. If the Registrar modifies or rejects that decision, then the

Registrar must provide written justification setting forth the reasons for the modification or rejection.

In this case, a hearing was held, and the administrative law judge issued a written decision. See

Administrative Law Judge Decision, attached.

MODIFICATION AND WRITTEN JUSTIFICATION

Page 1, ¶ 3, of the Decision lists December 23, 2015, as the date the Complainant filed a complaint

with the Registrar. However, the Registrar received Complainant’s complaint on December 23, 2014.

Page 2, ¶ 6, of the Decision lists April 5, 2015, as the date of the scheduled jobsite inspection. However,

the Registrar’s jobsite inspection was scheduled on March 5, 2015. Page 2, ¶ 7, of the Decision states “Pennington sent Respondent a Directive from the Registrar.” However, the Registrar’s Directive was sent by the assigned investigator Dimond. CONCLUSION AND ORDER For sake of clarity, the Registrar hereby replaces “December 23, 2015,” found on page 1, ¶ 3, of the Administrative Decision, with “December 23, 2014.” The Registrar replaces “April 5, 2015,” found on
