Under A.R.S. § 41-1092.08(B), the Registrar may review and modify an administrative

law judge’s written decision. If the Registrar modifies that decision, then the Registrar must

provide “written justification setting forth the reasons for the modification.” A.R.S. § 41-

1092.08(F)(1).

In this case, a hearing was held and the administrative law judge issued a written

decision. See Administrative Law Judge Decision, attached.

MODIFICATION AND WRITTEN JUSTIFICATION

The Administrative Law Judge Decision lists October 9, 2012, as the date of issuance of

the Cease and Desist Order on line 15, page 4. According to the Cease and Desist Order, Investigator Bermudez issued the order on October 9, 2014. Also, on page 4, paragraph 9, the Decision makes reference to Investigator Dalesio’s testimony. However, the investigator that testified in this matter was Investigator Bermudez. CONCLUSION AND ORDER The Registrar hereby replaces “October 9, 2012,” found on line 15, page 4 of the Administrative Law Judge Decision, with “October 9, 2014.” The Registrar also hereby replaces “Investigator Dalesio’s testimony,” found on page 4, paragraph 9 of the Administrative Law

In accordance with the Administrative Law Judge’s Decision, IT IS ORDERED that Respondent pay a civil penalty in the amount of $2,500.00 in certified funds payable to the Registrar by December 25, 2015.
