A hearing for this matter was commenced on November 18, 2015. Complainant appeared on his own behalf. Respondent appeared through its co- owner and president, Wayne A. Hewitt. After the parties’ representatives discussed their differences privately, they confirmed to the Administrative Law Judge that they had settled their dispute and stated the essential terms of their settlement on the record. The parties agreed that the Respondent would refund Complainant’s money to him and that within two weeks the Respondent would remove all construction materials from the property at issue and that Respondent would fill in the holes that were created on the property with the existing dirt on the property. The parties specifically agreed that Respondent would not be required to bring in new fill material. IT IS ORDERED vacating the remainder of the hearing on the merits that had been scheduled for November 18, 2015. IT IS FURTHER ORDERED remanding this matter under A.A.C.
