Under A.R.S. § 41-1092.08(B), the Registrar may review and accept, modify, or reject an administrative law judge’s written decision. If the Registrar modifies or rejects that decision, then the Registrar must provide written justification setting forth the reasons for the modification or rejection. In this case, a hearing was held and the administrative law judge issued a written decision. See Administrative Law Judge Decision, attached. MODIFICATION AND WRITTEN JUSTIFICATION The Administrative Law Judge concluded that the award provided by the Fund is an accurate reflection of Complainant’s actual damages. ALJ Decision 5:5-8. In the Notice of Claim for Administrative Payout, the Registrar found that Complainants’ actual damages were $6,538.18. However, the Administrative Law Judge recommended Complainant receive a payout from the Residential Contractor’ Recovery Fund in the amount of $6,553.18. ALJ Decision 5:12-13. In order to reflect the Administrative Law Judge’s findings, the Registrar modifies the Administrative Law Judge Decision to replace the amount of $6,553.18 with $6,538.18, as listed in the Notice of Claim for Administrative Payout. of 2 REGISTRAR OF CONTRACTORS 1700 W. CONCLUSION AND ORDER The Registrar hereby replaces “$6,553.18” found on page 4, ¶ 14, and on page 5, line 13, with “$6,538.18.” The Registrar hereby accepts the remainder of the Administrative Law Judge Decision, which becomes effective on April 17, 2016.
