On February 29, 2016, the Registrar of Contractors (“ROC”) issued a Notice of Claim for Administrative Payout. Respondent requested a hearing, which was noticed for May 10, 2016. The parties engaged in an off-the-record discussion that resulted in Respondent withdrawing its appeal of the Notice of Claim for Administrative Payout. Consequently, there is no longer any opposition to the Recovery Fund making payment to Complainant. The basic terms of the settlement, which were discussed on the record, are: Within sixty days of receiving payment from the Recovery Fund, Complainant will make available to Respondent the putting green, the Astroturf, and the decomposed granite. When the above-mentioned items are available, Complainant will contact Respondent’s attorney, after which Respondent will have three days to pick-up the putting green, the Astroturf, and the decomposed granite.
