Under A.R.S. § 41-1092.08(B), the Registrar may review and accept, modify, or reject an administrative law judge’s written decision. If the Registrar modifies or rejects that decision,

then the Registrar must provide written justification setting forth the reasons for the modification

or rejection.

In this case, a hearing was held and the administrative law judge issued a written

decision. See Administrative Law Judge Decision, attached.

MODIFICATION AND WRITTEN JUSTIFICATION

The Administrative Law Judge Decision recommends that this matter be dismissed. ALJ

Decision 6:13, “Order.” But in its Conclusions of Law, the Administrative Law Judge Decision

concludes that Respondent in fact violated A.R.S. § 32-1154(A)(2), -(3), and -(22). ALJ

Decision 6:1–2, ¶ 6. Given those violations, at least some discipline is warranted. The Registrar will therefore suspend Respondent’s license for one day. CONCLUSION AND ORDER The Registrar hereby rejects that portion of the Administrative Law Judge’s Decision recommending dismissal, modifies the Decision to the extent necessary to impose a one-day
