) ORDER Registrar of Contractors ) ) COMPLAINANT ) ) -v- ) Bri Sto Development Corporation ) License No. B-3.118092-R ) ) ) The Registrar adopts the Administrative Law Judge's attached Recommended Order with the following modifications: On page 7, line 14 insert a new paragraph “Pursuant to § 32-1125(D) Respondent is required to obtain a qualifying party within sixty days from the effective date of this Order. If Respondent fails to obtain a qualifying party within the sixty days from the effective date of this Order, the Register shall suspend Respondent’s license, with no further notice, until Respondent complies with § 32-1125(D).” Justification: Respondent holds the status as exempt from a Qualifying Party and has been found, after a hearing, in violation of A.R.S. § 32-1154(A) thereby the Registrar may require such a licensee to obtain a Qualifying Party. A.R.S. § 32-1125 (D) states: “A licensee which is exempt from the requirement for a qualifying party pursuant to subsection C of this section may be required by the registrar after a hearing to obtain a qualifying party within sixty days on a finding that: 1. A transfer of ownership of fifty per cent or more of the stock, if applicable, or beneficial interest, in the licensee has occurred. 2. A violation of section 32-1154 has occurred.”

Both of these situations have occurred and replacement of the qualifying party is now

required.

Based on this Decision, the Order, as modified, shall become effective on April 14, 2014.
