) Registrar of Contractors ) CASE NO: 2013-3441 ) COMPLAINANT ) ) DOCKET NO. 2013A-3441-ROC -v- ) Arizona Custom Stone LLC ) License No. K-48.224945-D ) ORDER ) RESPONDENT ) The Registrar adopts the Administrative Law Judge's attached Recommended Order with the following modifications: On page 9, line 23 delete “and to suspend . . . for 30 days.” On page 9, line 26½ “suspended for 30 days” shall be replaced with “revoked” and on page 10, line 1 “ten” shall be replaced with “30.” Justification: The Registrar maintains that revocation is warranted in this matter due to Respondent’s voluntary cancellation for License No. K-48.224945-D. A cancelled license cannot be reinstated and any periodic suspension is therefore futile. Further, pursuant A.R.S. § 32-1154(E) “The failure by a licensee to pay any civil penalty imposed under this subsection results in the automatic permanent revocation of the license thirty days [emphasis added] after the effective date of the order providing the civil penalty.” As such, the governing statute requires that Respondent be provided the full thirty (30) days to pay the civil penalty assessed in this case. Based on this Decision, the Order, as modified, shall become effective on April 21, 2014. IT IS SO ORDERED this 10th day of March, 2014. Registrar of Contractors
