) Patricia Kallof ) CASE NO: 2013-315 ) COMPLAINANT ) -v- ) DOCKET NO. 2013A-315-ROC License No. K-21.225867-D of ) Az Pavescapes LLC ) ) ORDER RESPONDENT ) ) The Registrar adopts the Administrative Law Judge's attached Findings of Fact and Conclusions of Law with the following modifications: On page1, lines 21-22 “7359 E. Norwood Street, Mesa,” shall be replaced with “6225 N. 29th Place, Phoenix.” The Registrar rejects the Administrative Law Judge’s attached Recommended Order and instead IT IS ORDERED that Respondent’s K-21.225867-D License be suspended for a period of thirty (30) days commencing upon the effective date of this Order. Immediately following the suspension period, Respondent’s K-21.225867-D License shall be placed on disciplinary probation for a period of one hundred and eighty (180) days. Note: As to the spelling of the Respondent’s qualifying party, Mr. Pena, the Registrar’s records show the spelling of Mr. Pena’s name as was provided on the application for its license. However, the Registrar has now corrected its records to reflect the spelling of Mr. Pena’s name to be “Eladio Pena” as was provided at the administrative hearing held in this matter. Justification: The Registrar maintains that a finite period of suspension is the proper discipline to impose in this matter, as the parties have already shown an inability to communicate and resolve their differences, thereby rendering provisional terms of discipline futile. Further, Respondent’s license is suspended for non-renewal as of December 1, 2013 and suspended for lack of bond as of December 13, 2013. Based on this Decision, the Order, as modified, shall become effective on January 27, 2014. IT IS SO ORDERED this 16th day of December, 2013. Registrar of Contractors
