) Registrar of Contractors ) CASE NO: 2013-2059 ) COMPLAINANT ) ) DOCKET NO. 2013A-2059-ROC -v- ) Service First Cooling & Heating LLC DBA: ) A/C Smart ) ORDER License No. C39R.270429-R ) L39-270428-C ) ) RESPONDENT ) The Registrar adopts the Administrative Law Judge's attached Recommended Order with the following modifications: On page 8, line 18 ½ insert a new paragraph “Pursuant to A.R.S. § 32-1154(E), IT IS FURTHER ORDERED that Respondent pay civil penalties totaling $9,000.00 to the Registrar, comprising of $1,000.oo for each violation of A.R.S. § 32-1154(A)(18) as charged in Counts Five, Six, Seven, Eight, Nine, Ten, Eleven, Twelve and Thirteen. If Respondent fails to pay this civil penalty amount in full within 30 days of the issuance of this Order, the Registrar shall automatically revoke Respondent’s license with no further notice. The Registrar shall not issue any future or additional contractor’s license to any entity comprised of persons associated with Respondent, as defined in A.R.S § 32-1101(A)(5), unless Respondent or any of the parties defined in A.R.S § 32-1101(A)(5) pays any and all outstanding civil penalties.” Justification: Contracting or offering to contract or submitting a bid while the license is under suspension or while the license is on inactive status is a serious violation reflecting disregard by the contractor for its responsibility as a licensee and mandating the imposition of an appropriate civil penalty. See A.R.S. § 32-1154(E). Based on this Decision, the Order, as written, shall become effective on April 14, 2015 IT IS SO ORDERED this 5th day of March, 2014.
