IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The hearing in this matter commenced on January 8, 2014. Respondent appeared and testimony from ROC investigator Jeff Helter and from complainant Robert Gates was heard. The hearing was not completed because Respondent informed the Administrative Law Judge he had recently found out that criminal charges were pending for the same conduct at issue here. He had not been served with any formal paperwork yet, but both parties were aware that criminal charges were coming. Respondent stated that he wants to consult with an attorney before testifying in this matter. He is also attempting to obtain a license from the ROC. He stated that he recently entered into a settlement with Mr. Gates. In addition, the Administrative Law Judge would like to give the criminal court time to process its case before moving forward on this matter. Good cause appearing, IT IS ORDERED setting a case status update for April 11, 2014. On or before that date, one or both parties shall file a written statement describing the status of the criminal matter and whether or not this ROC matter should be set for further hearing.
