A hearing had been scheduled on this date on the denial by the Registrar of Contractors’ denial of Applicant Penney Electric LLC’s application for a contractor’s license. Assistant Attorney General Montgomery Lee, Lawrence Mathews, Chief of the Registrar’s Licensing Department, and Paul Terek, Assistant Chief of Licensing, appeared on the state’s behalf. James W. Penney appeared on Penney Electric LLC’s behalf. At the time set for hearing, the parties reached a compromise that resolved all matters in dispute and stated the terms of their settlement agreement on the record. Therefore, IT IS ORDERED vacating the hearing on the merits that had been scheduled on this date at 8:00 a.m. IT IS FURTHER ORDERED remanding this matter under A.A.C. R2-19-111(3) to the Director of the Arizona Registrar of Contractors with the recommendation that if Penney Electric LLC complies with the terms of the settlement, it be licensed.
