Under A.R.S. § 41-1092.08(B), the Registrar may review and accept, modify, or reject an

administrative law judge’s written decision. If the Registrar modifies or rejects that decision,

then the Registrar must provide written justification setting forth the reasons for the modification

or rejection.

In this case, a hearing was held and the administrative law judge issued a written

decision. See Administrative Law Judge Decision, attached.

MODIFICATION AND WRITTEN JUSTIFICATION

The Administrative Law Judge Decision states that Investigator Frank Grochocki determined that a jobsite inspection was necessary to determine Complainant’s actual damages. ALJ Decision at p. 2, ¶ 12. Investigator Grochocki conducted the jobsite inspection, but Claims Reviewer James Barbour determined that a jobsite inspection was necessary during his review of Complainant’s recovery fund claim. Also, page 4 of the Decision refers to complainant as “Ms. Fung” instead of “Ms. Wung,”on paragraphs 16, 17, and 18. CONCLUSION AND ORDER The Registrar hereby replaces “Investigator Frank Grochocki” with “Mr. Barbour” on page 2, paragraph 12 of the Administrative Law Judge’s Decision. The Registrar also hereby
