The Registrar rejects the Administrative Law Judge’s Recommended Order, and instead IT IS ORDERED that Respondent’s C-34.221868-R License be suspended for a period of three (3) days to commence upon the effective date of this Order. Immediately following the suspension period, Respondent’s C-34.221868-R License shall be placed on probation for a period of ninety (90) days. Justification: The Registrar maintains that a finite period of suspension is proper discipline to impose in this matter. As no violation of § 32-1154(A)(23) was adjudicated to be supported by the evidence, a brief unconditional periodic suspension is the appropriate discipline to be imposed. Respondent’s relatively clean record with the Registrar mitigates the substantiated violation(s). Based on this Decision, the Order, as modified, shall become effective on February 10, 2014.
