The Registrar rejects the Administrative Law Judge’s attached Recommended Order. Instead, IT IS ORDERED that on the effective date of this Order Respondent’s B-1.217532-C License be suspended for a period of thirty (30) days. IT IS FURTHER ORDERED that in addition to the suspension imposed by this Order, Respondent’s B-1.217532-C License shall be placed on disciplinary probation for a period of twelve (12) months commencing on the expiration of the thirty-day suspension imposed by this Order. Justification: Respondent’s B-1.217532-C License was suspended for a period of seven (7) days followed by a six-month period of disciplinary probation in Case No. 2010-[number redacted]. Respondent’s B- 1.217532-C License was suspended for a period of fourteen (14) days in Case No. 2012-226. The Registrar maintains that progressive discipline is warranted in this matter based on Respondent’s violation of A.R.S. § 32-1154(A) and its prior disciplinary suspensions. Based on this Order, the Decision, as modified, shall become effective on August 28, 2013. Any request for rehearing must be filed on or before August 23, 2013. Any appeal to the Superior Court must be filed on or before the effective date set forth above.
