Johnson ) CASE NO: 2012-4419 ) COMPLAINANT ) ) DOCKET NO. 2012A-4419-ROC -v- ) License No. C-61.124828-R of ) Forsythe and Sons Construction Inc ) ORDER ) RESPONDENT ) The Registrar adopts the Administrative Law Judge's attached Recommended Order with the following modifications: On page 3, line 20, delete “not,” on page 5, line 8 ½ -15, “until the Registrar. . . Case No. 2012-4419” shall be replaced with “for a period of seven (7) days commencing upon the effective date of this Order. Immediately following the suspension period, Respondent’s C-61.124828-R License shall be placed on disciplinary probation for a period of ninety (90) days.” Justification: The Registrar maintains that a finite period suspension is the proper discipline to impose in this matter. Respondent had ample opportunity to comply with the terms of the Corrective Work Order issued in this matter and failed to do so. Furthermore, the record at hearing establishes that Respondent tried to evade its warranty obligations; thereby aggravating the violation. Respondent’s clean record with the Registrar mitigates the violation to the above brief suspension period. Based on this Decision, the Order, as modified, shall become effective on January 29, 2014.
