) Susan Pucelik ) CASE NO: 2012-4409 ) COMPLAINANT ) ) DOCKET NO. 2012A-4409-ROC -v- ) License No. KB-1.190936-D of ) Capital R Inc DBA: Capital R Construction ) ORDER ) RESPONDENT ) The Registrar adopts the Administrative Law Judge's attached Recommended Order with the following modifications: On page 1, line 22 “September 5, 2012,” shall be replaced with “September 7, 2012,” on page 4, line 3 ½ “Mr. David” shall be replaced with “Mr. Davis” and on page 9, lines 10-17, “until the Registrar. . . Case No. 2012-4409.” shall be replaced with “for a period of three (3) days effective upon the effective date of this Order. Immediately following the suspension period, Respondent’s KB-1.190936-D License shall be placed on disciplinary probation for a period of ninety (90) days.” Justification: The Registrar maintains that an unconditional periodic suspension is the proper discipline to impose in this matter. Respondent had an opportunity to correct the grout in the pavers and failed to do so. However, at hearing, it was found that Complainant unreasonably denied access to Respondent to address irrigation issues. Therefore, further provisional discipline would likely inflame the situation. Respondent’s relatively clean record with the Registrar mitigates the imposition of suspension to be imposed as stated above. Based on this Decision, the Order, as modified, shall become effective on January 29, 2014. IT IS SO ORDERED this 20th day of December, 2013. Registrar of Contractors
