HEARING: October 29, 2013, at 8:00 a.m. APPEARANCES: Jim Cain and Merritt Cain (hereinafter “Complainants”) failed to appear. Desert West Cooling and Heating Inc., failed to appear. . ADMINISTRATIVE LAW JUDGE: M. Douglas

Based upon the entire record, the following Findings of Fact, Conclusions of Law and Recommended Order are made: FINDINGS OF FACT 1. Complainants failed to appear at the hearing. The tribunal waited 20 minutes beyond the scheduled start time, but no one appeared for Complainants. CONCLUSIONS OF LAW 1. By failing to appear at the hearing, Complainants did not meet the burden to present evidence in support of the complaint.[1] RECOMMENDed order Based on the foregoing, it is recommended that this complaint be dismissed.

In the event of certification of this Administrative Law Judge Decision by the Director of the Office of Administrative Hearings, the effective date of the order will be 40 days from the date of the certification. Done this day, October 29, 2013.
