Vacate: Settlement Recommendation

IN THE OFFICE OF ADMINISTRATIVE HEARINGS

A hearing had been scheduled on this date on Complainant Desert Valley Developer and Contractor LLC’s complaint to the Arizona Registrar of Contractors (“the Registrar”) against Respondent E H S Restoration LLC’s License No. C-61.268188-R for violation of A.R.S. § 32-1154(A)(11). At the beginning of the hearing, the parties’ representatives requested a recess to discuss their dispute privately. After the recess, the parties’ representatives informed the Administrative Law Judge that they had made a settlement and provided a writing memorializing the terms of their settlement. Complainant’s representative agreed to withdraw the complaint to the Registrar. A copy of the parties’ settlement is attached to the Registrar’s copy of this order. Therefore, IT IS ORDERED vacating the remainder of the hearing on the merits that had been scheduled on this date at 8:00 a.m. IT IS FURTHER ORDERED remanding this matter under A.A.C. R2-19-111(3) to the Director of the Arizona Registrar of Contractors for further action. Done this day, June 25, 2012.
