A status conference was held on this date. Complainant North Star Pipelines Inc.’s representative, Mike Rowley, appeared and stated that Respondent D G Fenn Construction Inc. had given Complainant a check for $5,000.00, as the parties’ settlement required, but that Complainant had not yet negotiated the check. Respondent did not appear at the status conference. Therefore, IT IS ORDERED holding the record open in this matter until January 17, 2013, to allow Complainant to negotiate Respondent’s check. Complainant shall inform the Office of Administrative Hearings in writing, with a copy to the Registrar and to Respondent, whether or not the check clears. If the check clears, the Administrative Law Judge will remand this matter to the Registrar with the recommendation that it be closed as resolved/settled/withdrawn. If the check does not clear, the Administrative Law Judge will schedule a further hearing on the merits.
