Vacate: Settlement Recommendation

A compliance hearing on the merits had been scheduled on this date. The Registrar’s inspector, Mark Alyea, testified about that opinions that he formed during his compliance inspection. After a recess, Complainant Robert Caldwell and Respondent Hays Roofing, Inc.’s president, Gary Watson, agreed to a settlement to resolve the remaining items of disputed workmanship and recited the terms of their settlement onto the record. Complainants agreed to withdraw their complaint and Respondent agreed that the Registrar might close the complaint as resolved, settled, or withdrawn. Therefore, IT IS ORDERED vacating the remainder of the compliance hearing on the merits that had been scheduled on this date at 8:00 a.m. IT IS FURTHER ORDERED remanding this matter under A.A.C. R2-19-111(3) to the Director of the Arizona Registrar of Contractors with the recommendation that it be closed as resolved/settled/withdrawn. Done this day, February 16, 2012.
