IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The parties’ attorneys have submitted a joint motion to vacate the hearing and stay Complainant’s Complaint for Non-Payment under A.R.S. § 32- 1154(A)(11) pending the outcome of the concurrent judicial action in Superior Court or settlement. Therefore, IT IS ORDERED vacating the hearing that had been scheduled on September 24, 2012, at 8:00 a.m. IT IS FURTHER ORDERED remanding this matter under A.A.C. R2-19-111(3) to the Director of the Arizona Registrar of Contractors (“the Registrar”) for further action. If Complainant establishes in the Superior Court action that Respondent committed acts that arguably constitute a violation of A.R.S. § 32-1154(A)(11), Complainant may request that the Registrar reopen Complainant’s administrative complaint against Respondent and refer it to the Office of Administrative Hearings for an evidentiary hearing.
