IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This case concerns Complainants’ eligibility for recovery from the Residential Contractors’ Recovery Fund (“the Fund”). The Fund denied eligibility due to tax classification of the property. Complainants requested a hearing. At the hearing, Complainants and the Fund appeared; Respondent did not. Upon agreement of the parties that were present, the case was set for case status update while Complainants sought a retroactive change in property classification from the county assessor’s office. On March 28, 2013, counsel for the Fund notified this tribunal that the Fund withdraws its intervention in this matter and its objection to Complainants’ eligibility. There being no further issues to adjudicate, IT IS HEREBY ORDERED that this matter is vacated and remanded to the Residential Contractors’ Recovery Fund for further processing.
