Vacate: Settlement Recommendation

IN THE OFFICE OF ADMINISTRATIVE HEARINGS

A hearing on the merits had been scheduled on this date. At the beginning of the hearing, the parties informed the Administrative Law Judge that they had settled their dispute and read the terms of their settlement onto the record. In addition, Complainant John Coleman and Respondent’s representative, its qualifying party and member, Peter Marquardt, executed a written settlement agreement setting forth the terms of their settlement and allowed the Administrative Law Judge to make a copy of the agreement for the file of the Office of Administrative Hearings. Mr. Coleman agreed to withdraw his complaint to the Registrar and Mr. Marquardt agreed that the complaint could be closed as resolved, settled, or withdrawn. Therefore, IT IS ORDERED vacating the hearing on the merits that had been scheduled on this date at 8:00 a.m. IT IS FURTHER ORDERED remanding this matter under A.A.C. R2-19-111(3) to the Director of the Arizona Registrar of Contractors for further action. Done this day, February 7, 2012.
