IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Pursuant to the Notice of Hearing issued by the Registrar of Contractors (“Registrar”), this matter came on for hearing before the Office of Administrative Hearings, an independent agency, on October 4, 2011, at 1:00 p.m. Old West Granite Co., L.L.C. (“Complainant”) was represented by its authorized representative, Dave Hanlon. Meramont Construction, Inc. (“Respondent”) was represented by its authorized representative, Nathen Lentz. Prior to the commencement of the hearing, the Administrative Law Judge gave the parties time to discuss possible settlement. When the hearing convened, Complainant’s representative announced that Complainant was withdrawing its complaint against Respondent. Respondent’s representative did not object to Complainant’s withdrawal of its complaint and acknowledged that the Registrar’s records would reflect that the above-entitled matter be listed as “Closed Complaints – Resolved/Settled/Withdrawn.” In view of the foregoing, IT IS ORDERED that the above entitled matter be vacated from the calendar of the Office of Administrative Hearings and remanded to the Registrar for further action.
