A hearing on the merits had been scheduled on this date on Complainant Eagle Rock Underground, L.L.C.’s complaint against Respondent R B G Construction Company, L.L.C. to the Registrar of Contractors (“the Registrar”) for non-payment under A.R.S. § 32-1154(A)(11). At the time scheduled for hearing, the parties engaged in settlement negotiations and ultimately settled the complaint, reducing the terms of their settlement to writing. On the record, the parties confirmed their settlement, Complainant’s representatives agreed to withdraw their complaint, and Respondent’s attorney agreed that the Registrar could close the complaint as resolved, settled, or withdrawn. Therefore, IT IS ORDERED vacating the remainder of the hearing on the merits that had been scheduled on this date at 8:00 a.m. IT IS FURTHER ORDERED remanding this matter under A.A.C. R2-19-111(3) to the Director of the Registrar for further action. Done this day, March 9, 2012.
